Litigation finance, or third party funding, is a new tool with which a third-party investor covers the litigation costs of one party to a dispute. If that party wins, the investor will receive a percentage of the amount awarded. A similar instrument was developed in the US about 25 years ago. The volume of the market in 2017 exceeded $5 billion, with explosive growth taking place in 2013 to 2016 to reach 414%. The largest funders in the US are Juridica Investments and Burford Capital as well as law firms Law Finance Group and Counsel Financial Services.

Andrei Gusev, Managing Partner of Borenius Russia, shared his opinion with Kommersant newspaper on the prospects for the development of litigation finance in Russia and the current difficulties preventing investments from being attracted.
