An architectural solution as an item covered by an exclusive right / Legal Insight

Although as far back as 2011 the Presidium of the Russian Supreme Commercial Court drew a line under the issue of what part of project documentation should be recognised as a copyright item, disputes still emerge in this area. To avoid any adverse effects when rights to an architectural solution arise and are disposed of, a number of important factors must be taken into account.

Arina Dovzhenko, Specialist Partner and Head of our Real Estate and Construction Practice, and Vera Zotova, an Associate in our Intellectual Property and Information Technologies Practice, have written an article for the journal Legal Insight about how intellectual property is protected in construction, how rights to an architectural solution are safeguarded, how an exclusive right is transferred, and how an architectural solution is used and whether it can be reproduced.
