One step from criminal liability to subsidiary liability / Meeting at the Clubhouse
On April 13, specialists from various fields of business, finance, and law met to discuss bankruptcy proceedings. The lineup of speakers—creditors, bankruptcy and arbitration managers, lawyers, criminal and arbitration lawyers—took a thorough approach to the perception of bankruptcy.
Andrew Bezhan, Counsel of the Dispute Resolution Practice of Borenius Russia, addressed three issues. He focused on problems of proof in subsidiary liability cases, expanded on the concept of and criteria for controlling the debtor, and explained the grounds for imposing subsidiary liability on the controlling debtor. During Andrew’s speech, participants discussed the problems that arise when proving controlling person status and shared their experience in such cases.
